This is a common misapprehension
Software is only licensed it is not "sold"
Limited use of the software is granted in very tightly controlled circumstances..
There are slight differences in different jurisdictions.
Hell, you're not even supposed to sell it on.
It's all in that users agreement that everyone clicks through at the start of every install. (Which is legally binding)
We don't own anything but the disc!!!

Possibly, but looking at it from Eidos' point of view: what would they achieve by banning fans from using T2 textures in T1 missions (or vice versa) - they would achieve a certain amount of ill-will and discontent among the fans who would see them as a money-grubbing corporation. They would also not achieve any more sales of the game, because nobody buys a game to have access to the textures.
If an entire Thief 1 level is ported to Thief 2, that has the potential to directly impact sales of Thief 1. Someone says "Oh, I'm not sure whether I should buy Thief 1. I hate undead and monsters, but someone told me that Assassins was a good level", then if that person has a chance to just grab a port of Assassins for T2, they will not buy Thief 1 and Eidos would lose money.
So yes, technically, both are illegal, but Eidos would have more to lose than gain by cracking down on texture usage.

If so, here's an idea that would allow porting TDP/TG missions to TMA without Eidos "losing sales": port the missions, but in such a way that they require TDP/TG files to run.

Although with the current crop of "ethics" (actually lack thereof) and "moral" behavior (also in short supply). I'm not surprised that "illegal" basically has come to mean: "Ignore the rules and don't get caught."
"I want it therefore, I'll just take it." seems to be the norm, as in "Screw you I'll do it anyway".
