Concerning the original Xbox, 95% of homebrewed programs had to be compiled with files ripped from the original Microsoft devkit. Hence why you don't see many sites with HTTP direct downloads of compiled Xbox homebrew, just source code.

I just took a trudge on Google, and it looks like the issue might be that the modification installs an altered BIOS version that, on its own, already represents an infringement of Microsoft's IP rights. If the alternate software wasn't based on MS's own product, it shouldn't be illegal just because it may allow users to perform copyright infringements later, just as the PC Daemon Tools are not illegal either.

I'm not sure what happened here, but clearly more DRM is the answer.

I agree with fett, they should put DRM into Windows and all Linux distros by law that prevent anyone from accessing any bittorrent sites or other bad things on the internets. That would clearly solve all of our problems, including the current economic crisis.

I'm not so sure about that. I think some of those illegal modders/downloaders/hackers etc might increase the suicide rate without their beloved internet(s)
In any event, DRM is most definitely the answer!, more SecuROM please!
