The launcher for the game shows an option to select DX9 as opposed to DX10; it's greyed out though. The demo doesn't run in DX9 as far as I can tell, but the full game might.

Since it's a PhysX demo, and not a proper game demo, it not only needs DX10, but an nVidia card with PhysX in order to run at all.
