No, but if the trampoline broke and I fell through onto a spike in the lawn and was injured I might. I might be partially to blame, but the product shouldn't have done that.
And the grey area is exactly why these things are usually handled on a case by case basis in negligence suits and is why, despite Papy's fears, you can still buy hot coffee from a shop. (It was hot wasn't it ¬¬)
@ Chimpy/Subjective Effect: I was envisioning a bizarre cartoony type thing where the parts of the bed snapped up like a trap and broke the person's back or something. (So Subjective Effect is pretty much there.)

Actually I would expect to be found at least partially to blame (Just like whatshername) because even if the trampoline shouldn't have broken it is pretty dumb to put it over a spike.

25% of all fractures to children's arms/legs at my old job were caused by trampoline accident. Guess what the head of orthopaedic surgery bought his kids? People will do ANYTHING even when they know the risks.

I think society as a whole can agree that giant trampolines are awesome enough to be worth it. How could a jury cast blame on something so fabulous?
