Wow. I'm surprised they settled it. If I were Take-2, I would have been pissed at all of that lost money and I would have tried to get control of the Duke franchise. I am a 3D Realms fan, but there's no excuse for what they did. (delaying the game for so long and all)
I suppose (as a fan of Duke) it is time to face facts. This game will never come out, and even if it ever does, it will be watered down for the console cretins. This means we won't have a good mapping/modding scene, like we still do for Quake/Doom/Unreal/Duke3d.
I suppose I should have seen the writing on the wall when they kept releasing third-person console Duke games a decade ago. Why won't they just give us what we want?
I want a long single-player game with no cut-scenes and full featured multiplayer that includes co-op, CTF, and DM.

If I recall correctly, Take Two basically put no money into the project, and were demanding repayment of something they never gave in the first place. Granted, 3DR did completely fail to produce a game, but Take Two didn't lose much besides the potential to make money.
