Was to be expected from someone who 1. buys from a retailer 2. buys used games 3. gets their used copy for 5 dollars cheaper than the price of a new one.

What the fuck is up with your title? Or is that there some sarcasm that flew over my head? The publisher doesn't fit into this - since the game in question is Dragon Age, I can tell you the terms are stated on the back of the box:

The fault is the customer's, if they failed to take an interest in that specification, and Gamestop are merely being dicks for conveniently failing to draw attention to it and the resulting fact of their sale being $15 short on content when compared to the original.

On a more serious note, I wouldn't be surprised if either:
A. This lawsuit gets thrown out for being completely frivolous (OMG my $10!1one).
B. GameStop gives the guy a store-credit, taking a loss in the process due to the predatory game publishers.
I agree with A, but not B.

You know what's funny? The lawsuit actually mentions this, I think the point being that the print is too small for customers to notice or something. Not sure how GameStop is supposed to be responsible for that, though.

Well, if they're going to resell it, and it has a big ad for free dlc on the box they put it out in, is it really unreasonable to expect them to make a note on the box of their reselling package? But it's in pure legal territory there. Morally - fuck gamestop. They know the DLC is $15 for used owners, but still sell it used for only $5 less then new. They knew what they were doing, and there was deceptive intent there.

To be fair, (like Briareos H points out), anyone who buys a second hand game at only 5 bucks less than the 60 buck "new" price is someone who is so penny-pinchingly dickfaced they really should've read the small print in the first place.
