I am amused at their 'console, not computer' argument given that they argued the exact opposite for the PS2 a few years ago to try to get around EU import taxes.

Yeah I particularly like the part about it being "subject to change". I can imagine buying a car and driving one day, only to have the stereo just stop working. I call the manufacturer, and they tell me "we remotely disabled your stereo, because your car is subject to change". After all, most modern cars *DO* have software running in them.

No man, the stereo never comes with the car in the first place; it will be available as a DLC three months later.

I disagree. Its more like ripping the stereo out of a car and trying to put one in that some guy made in his basement and gave you for free. And then having the car company shoot internet rays at your car and make the radio stop working.

I only recently decided to finally buy a wireless router, went down to my local electronics shop and splurged on a marked-down $30 D-link Wireless G router with a free PCI wifi card bundled in - apparently it was a last of range, woohoo bargains. I got home, installed it, downloaded tversity, and everything's been going swimmingly since - haven't noticed any issues wtih utorrent running simultaneously.
The only thing that sucks is the lack of playlist/run in background for tversity music player, but otherwise it fucking rocks.

Okay, so my analogy was a little inappropriate. Here's a better one.
The car comes with a slot for a stereo and the manufacturer brags about us being able to install our own. Then one day, I'm driving and the stereo I installed falls out, as the hole is remotely filled with cement by the car manufacturer.

I agree with the idea behind the lawsuit on a fundamental level. That doesn't stop this Ventura fella from looking like an opportunistic asswipe who just saw the chance to squeeze some $$$ out of Sony. It's not like the removal of OtherOS functionality alters the fundamental and intrinsic value of the console to the vast majority of the public.
It's highly unlikely Ventura's going to win anyway. Like an astute individual in a comments thread somewhere pointed out, Sony already outlined the possibility of functionality being removed in future updates in the TOS.
