Why not start a more safer career with indie games and then founding a small game company and when you build a name for yourself try to have a proper negotiation with Nintendo ?

Or take out a loan and actually PAY for the development license. Like DEVELOPERS do. Or approach a publisher that has a good track record with indie developers and try to sell the game to them. Making a game using technically illegal homebrew libraries and compilers, and then whining about the owner of the platform not giving you permission, free of charge, to sell it at retail is just ignorant.

It seems more the case, if you read his (rather confusing) website that all he wants is for Nintendo to sell him the SDK (so that he can legitimately publish his game), which they apparently won't.
