Not all retro related console games are frustrating. If anything there is a sea of great games to be found within them. Worlds your oyster on that front.
But for more "next gen" here is a few that spring to mind:
* Any of the Civilization games
* Evoland
* Psychonauts
* Spore
* Steamworld Dig

Make sure you get the expansions for the one you get him if you get him any of them. Especially if you get Civ V, while it's still a game without the expansions, the expansions (mostly Brave New World) make it far more enjoyable than vanilla.
If he has nostalgia for old console rpgs, sure. Otherwise stay away from this, as most of it is a huge nostalgia trip for console rpgs with few things for people without nostalgia goggles.

BTW about Dark Souls' rating -- the violence is really low (not that much blood for all the slashing and bashing) and I really don't know where the partial nudity comes in except maybe in a boss this kid's probably not gonna see until he's 17 anyway.

Well, it is kinda gory in places, though it's more in a grotesque way, rather than a directly violent one. You have tons of half rotted carcasses lying about with bones and organs exposed, people with egg sacks growing underneath their skin, or a giant rat with an axe sticking out of its eye socket. Things of that nature.
...things a 12 year old boy would likely think are all kinds of bad 'n rad, in other words, but the parents wouldn't necessarily approve. That's what ultimately matters here.
And I won't even count titty spider. 2.3 seconds of briefly glimpsed underboob is hardly scandalous, and won't scar any delicate developing psyches.
