Over at 'Planet Elder Scrolls', a site that has many mods for the Elder Scrolls games, there are some files put up by someone named 'Walthar'. The mods that Walthar has are sound replacements, most of which include sounds from Thief. But nowhere does Walthar state that the sounds belong to Eidos. Is this legal?
poison_the_well on 30/7/2007 at 03:03
as long as they dont try to make a game=for sale,i dont think it is aginst the law, since looking glass gave the fan dromed to use for missions, which includes sounds
Shadak on 30/7/2007 at 03:07
I don't think that's the correct way to look at it, and I think it is in fact illegal
poison_the_well on 30/7/2007 at 03:11
to post files to thief sounds from thief 1 or 2 or gold is not illlegal for fan missions or even if they want to make a music mix
now if they are going to use the sounds to say make a game and sell
i am trying to see what you think is wrong with what they did?
i have seen thief people post on site all kinds of thief stuff, what is the diffence
soon thief 1 will be freeware forgot how many year it has to be i think 8 years old, might be more or less

What about posting movies with Thief content (including video of the game, sounds and music from the game)? Without selling or anything of course. I assume thats ok, but I'm not sure.

That's easy - they didn't give credit to the source of the material.
poison_the_well on 30/7/2007 at 05:51
why would they have to give credit, since i take it they not making money on it,also looking glass studios gave dromed to the public=thief 1 and gold and 2
i would have to say i think if anything is illegal it is the fact that the thief 3 soundtrack was released,i dont think ion storm would like that, but no one ever brings that up

You're kidding, right? :wot:
Because of the media companies like Disney crying to the government, copyrights in the US have been extended to ridiculous lengths.
As it stands now, if a copyright is held by a single author, it's in effect for the life of the author, plus 70 years. If a copyright is held by a corporation, it stays in effect for 120 years after creation, or 95 years after publication, whichever is shortest.
Thief won't pass into the public domain until around 2093, unless Eidos decides to renounce their copyright, or sell it to someone else who does.

Profiting or not is irrelevant, you always have to credit source material when it's not an original creation. And Eidos/LGS didn't forfeit any of their ownership of original T1/T2 material just because they released Dromed to the public - why would you assume that? Go read the Dromed EULA and you'll see that they gave up nothing.

They have to give credit because the source materials BELONG to Eidos...that's why. Looking Glass
RELEASED Dromed to allow us to build our own fan missions with the original content, it did
NOT in any way
give us anything. The
CONTENT(textures, sounds, models), are property of Eidos...we simply have permission to play with them, not do with them as we please. The folks on here are telling you that it is Illegal, and it IS...so that's it. All things Thief, sounds, textures, models...etc, belong to Eidos games...and Eidos games still sells Thief 1,2 and 3. Technically, we're not even supposed to put sounds or textures from the different Thief games, into one of the others.

A couple of points:
1. Ion Storm went out of business, it's dead...gone. So the only folks that matter right now are Eidos.
2. The Sound Track is
NOT available for purchase, and it was also released to us by a former developer at Ion Storm....it has nothing to do with any of us here. By your own logic, it should be as valid as LGS releasing Dromed, since the sound track came from a Developer, just like Dromed.
Sorry if I'm coming across as rude, but your being exceptionally thick headed about all of this.
If the folks who have been modding and playing thief for years tell you it's Illegal, then it is.
