Profiting or not is irrelevant, you always have to credit source material when it's not an original creation. And Eidos/LGS didn't forfeit any of their ownership of original T1/T2 material just because they released Dromed to the public - why would you assume that? Go read the Dromed EULA and you'll see that they gave up nothing.
In fact, according to the dromed license
Looking Glass Studios owns our fan missions!Since Looking Glass is no more, I assume that the ownership of all the fan missions has transferred to Eidos, the owner of the Thief license.

Over at 'Planet Elder Scrolls', a site that has many mods for the Elder Scrolls games, there are some files put up by someone named 'Walthar'. The mods that Walthar has are sound replacements, most of which include sounds from Thief. But nowhere does Walthar state that the sounds belong to Eidos. Is this legal?
Before some thick headed twit tells me his dad is a lawyer and says it's 100% legal like in the Dark Mod thread, time to take action against this guy.

The last time I checked, the DarkMod team wasn't using any media from the original Thief games, unlike 'Walthar'.

So what he's doing is illegal and I should report him to the website?
jay pettitt on 30/7/2007 at 17:19
ToolFan seems keen, I'd delegate the reporting bit to him. It's fun being a community.

We're not, but I think he was referring to something within the thread...not us specifically.

from what i heard the guy in question was simply posting some thief music from part 1 or 2,without posting it the credited source
poor guy just probaly wanted to let some people hear some thief music
and some of the thief people in here are stright snitches
"how weird is that they play a game where they are theives, but in real life they snitches" lol how funny is that
i was never one to follow the rules since the rules

You didn't ask if we thought he would get in trouble, you asked if it was legal. Whether or not you get punished has no effect on legality.
