Does Rank go by what level you are? or by the quest that you have completed?

Ranks are gained by finishing quests, it doesn't matte what level you are.

Indeed, though you WILL need to level up if some of your skills or stats aren't high enough for the next rank.

You need do have done enough quests for them and meet the requirements which can be seen when you hold your mouse over a guild (or press 'y' if you are on xbox). It normally requires having one skill (from the given list of skills) at a high level and 2 other skills at a relatively low level (but still high enough that you have to level it up to meet the requirements).
