It is a cloaking device in the sense that the whole idea of a cloak metaphor is that some area is getting constructed around an object that light can't or doesn't get into to detect it. Whether that area is constructed by bending light around it or by actually breaking the light up into bands that gap over it is sort of just semantics. It's a device, and there's a cloak of non-interaction around the thing, at least as long as it stays inside the gap. What more do you want?
