Yes, dirt, stain, smut, and other types of decal are included in the Release.
Don't take my comment about that one FM to be an indication that it is an impossibly huge task to add dirt decals. As I said, that FM has a lot of fine physical detail, trim, etc. so it is more work. Take a look at a more typical FM. Look at Saint Lucia at the streaks of dirt on the walls of the houses in the street. Look at the more sparse use of decals as mould in the Thief's Den basement. It is all part of the building process. And many enjoyable Thief FMs have been made without it and the same is true for Dark Mod.
Basically, dirt decals are just semi transparent sheets that you paste onto walls like cellophane with a stain on it. There is a feature in the Dark Radiant editor: Just select a surface, a wall or floor or whatever and click 'create decal'. You might need to drag it to resize it if the wall is made up of several surfaces. Then you just select the dirt decal texture you want. But to do that with the complex trim and fine recesses in that screenshot that was posted earlier as you can imagine you cannot just paste one big decal over the lot so something that complex needs more work. A typical FM the decals represent a very small part of the work involved.

It isn't a terms of use situation. There have been many a times I've started working on a texture, just to see someone else has already done an almost identical one from the same source shot and vice versa. It's a problem we'll all be facing as long as we're pooling from the same site.
