That's only because those working on it are having to tread softly for now, due to how the code was leaked. Although to be honest, if you're not a programmer, nothing much of interest has happened yet. It may still be quite some time before a usable build is achieved, which is the first thing most people here would care about knowing. Or that might never happen unless Eidos releases the full source to the community.

Posting copyrighted works without expressed written permission is against the law. Discussing copyrighted works is free speech.
I do not see the harm in a discussion about what is missing in the code dump that was leaked.
By simply looking at the header files, one can clearly see numerous missing directories that presumably hold needed code.
The code also references third party licensed code. The fee to license qmixer is considerable according to the copyright owner. If any code is officially released and licensed to this community, all references to this third party code would need to be redacted.
If their legal department ever agrees to an acceptable licensing agreement, someone must redact the code to comply with it. I do not see that happening any time soon.

This is paranoia. I think Eidos simply does not give a fuck about the source code anymore and it was not giving an answer about it because it was so low on its priority list that it could not even begin to be bothered about it.

probably.but,unless they make it official (that they do not give a damn),the possibility of getting chased around by a bunch of lawyers that do not have anything better to do will always be there,so why taking the risk?
edit: just noticed that there are still links to the leaked code floating around the forum(s),these should be purged,if not anything else.
