Lawyers never make decisions. They advise their clients with written opinions based upon their understanding of relevant case law. No legal team would take over a year to render an opinion to their client.
I do not believe that anyone from eidos has contacted any decision making executive within the company to request any action regarding the source code.
Given the fact that a copy of the source code is in their possession, the decision is not very difficult to make. If an executive at eidos makes a decision to release the code, then that executive would allocate a resource to sanitize the code of third party intellectual property and then release it under some form of licensing. If the decision is not to release the code, then convey that decision to the public.

I strongly suspect VIKTORIA's just repeating what I'd been saying since March because of people still contacting Eidos, Square-Enix, and EM ignorantly, not knowing the code was found.

I was sure that the Source Leak would've been newsworthy but it seems that the savvy tech journals have probably come to the conclusion that:
1 ) 99% of the interested audience will just go "Meh" if nothing playable is available.
2) This is an old game from a niche genre so that leaves 1% of an already (perceived) small population
If you wanted to get the media pressure boiling I imagine you could do something like:
1) Port OPDE to work on PS3\iPad\etc
2) Tack arbitrary portions of the leaked code into this OPDE port (whether they do anything or not)
3) Create a Youtube video "proving" that you have begun to get Thief working on a PS3\iPad\etc
4) Small media frenzy
5) Opportunity to bring up the Source Code grievance\petition during the hoopla
They may not care about Thief but "Leaked code of old game used to create version that runs on trendy device X" is always newsworthy. :angel:
