Exactly. If the dark engine source is ever discovered, or if OpenDarkEngine ever gets completed, we should create a game that recreates what made the thief series so fun. I'm not talking about TDM, that is not a "true" thief game as it does not try to recreate the original games from what the original games started from. And, if features such as universal lighting, voxel (well, not exactly Crysis voxels, but close enough, y' never know), and a support for even higher quality texture and meshes (doom 3 quality) are added to the engine (or its open source understudy), it could be a step for not only thief fans, but newcomers who are weary of trying out the older games simply because they've aged a bit...

I think you missed something really important there. In fact, it's the same point we've been trying to make throughout this whole thread:
Eidos owns the rights to Thief, so only
they can create a legal remake of it.

Nobody can recreate the original games from where they started from. How many bloody times do people have to explain this in the thread before it's understood? You can't recreate the original games in any engine, the games belong to Eidos. Porting a Thief 1 level into Thief 2 is illegal. So, redistributing remakes of the original levels, even if they were to be used in Dark Engine, would still be illegal. That takes us back to making a game like T2X, which is pretty much a spiritual successor to Thief and no more of a 'real' Thief game than TDM since it uses all new content, new characters, and new voices...even though it's in the dark engine. T2X was made by FANS, for FANS...and TDM is also being made by FANS, for the FANS. As long as the gameplay is there, TDM can be just as 'real' as anything else.

Subjective Effect: Well and good points. Though, as you said, it will ship with some missions along with it, and people WILL make FMs with it. So, in essence, I see it as a game. Call it what you want, but it's essentially a game once it's been released and people start building with it.:) I see that I made a silly mistake though in my previous post by calling it flat out a "game", and I should know better because I know it's a "toolset".... but what it does is allow for a "game" in the sense of FMs I guess is what I'm getting at. The Dark Mod is like a total conversion for doom 3.

No, its not a game and if no one bothers to make any FMs you'll never play anything with it.
And it's not
like a total conversion, it IS a total conversion. Its the 1st line on the website ffs.

Some people are going to be very disappointed. Look, I've spoken to a few people over the past month who really don't get that TDM is a toolset; people who think it is a new T2X. And I'd really rather people didn't get the wrong idea because I think TDM is great but people getting the wrong end of the stick will only moan and disseminate discontent. For that reason I'm keen on stamping out this "game" idea I keep reading.

I think the key thing to remember is that you can release any game, level or media that contains references to copyrighted intellectual property, as long as said media requires the original intellectual property to be owned by the downloader.
That's why there's nothing wrong with T2X - you need to have bought Thief 2 to be able to play it.
That's why the Dark Mod needs to have no references to Thief in it, because you don't need to own a Thief game to play it, and therefore any references to Thief would count as theft of intellectual property.
On another note, Black Mesa Source is a slightly grey area - to be fully technically legal, it would need to be released in such a way that means you need Half-Life 1 to play it; but in this particular case, Valve have essentially given their blessing to the project to break the law. The likelihood is that Valve will step in at the end and make people buy Black Mesa Source, but that's a different matter entirely.
