Maybe, but then doom 3 itself isn't even that popular, and it's already an old game.:erg:
Then it wouldn't be of any consequences; except for me if they have nothing better to do than sue me.

Yes, but proving that it contains Eidos' IP would be hard. Unless you are specific about what they are supposed to be (naming them) and/or copy textures from Thief 1,2 and 3 then there is a big gray area.
So if I am suficiently subtle about it there should be no suing.

If Eidos decided to go after you, yep...it would be illegal.
...and I won't give a damn;
I won't be selling anything,
I won't make them a bad publicity,
and I will not harm their profit in any way.
I keep thinking there's something wrong with the very definition of intellectual property today, or at least in the way it's inforced.

Why is it any less appealing? How does it affect your story? How is it any different from FM's that don't use Garrett as the main character? We have similar factions in TDM, but with different names. Our Hammer like faction are called The Builders.
It is a work of love , yes, and I admire it.
It still feels like saccharine compared to the sugar of thief, storywise, to those not involved in that project...for now .
In conclusion;
I should be able to make some FMs that take place in the Thief universe, as long as I don't actively advertise it as being official, and I don't copy any material from the original thief games.
Wether I'm sued is my problem.

That still leaves you with the use of their intellectual properly. Regardless of whether or not 'you' advertise it as official is likely going to be irrelevant. If Eidos saw it as an infringement, their lawyers would no doubt just see an FM and TDM as one in the same...meaning, we would have to remove Dark Mod from existence...or be sued.

Potentially, but it would depend on whether or not Eidos saw it as one FM built for TDM or decided to paint the entire TDM project with one brush. We just don't know, which is why we ask potential FM makers to please respect the intellectual property of Eidos. The franchise belongs to them, and though we may not see the harm in someone creating an FM in a 'competitors' engine and having people play with those characters and creations for free...I'm sure Eidos would easily see it another way.
Personally, the TDM team gives a damn because it's five years of our hard work on the line. We ask people to be respectful of Eidos intellectual property in order to avoid any unfortunate circumstances.

Well, I guess you're right; but what a sad sad world we live in :tsktsk:
I should pray for thief 4 to be either an abysmal failure, or for it being decently easy to make mods for; to avoid the menace of eidos' lawyers.
