thats a very good point, but I'd assumed he meant it would run from an exe in the same way as T2X, i.e. without Dark/Garrettloader

But T2X isn't a standalone game. You still need a Thief2 installation. However, sometimes people get their terminology wrong. A T2X style .exe could be exactly what TypeRed means.

Let's not muddy the discussion by comparisons to other ongoing efforts. The fact is, if someone will be able to play this mission using only his distro, without owning or having T2 installed, then it's illegal. Eidos owns the IP to everything originally created by LGS. In fact, I think under the T&C of Dromed, Eidos owns all rights to the fan missions we create here as well, including this one. But if he means simply a T2X style installer that requires T2 to be installed, that would be fine (although for a simple FM like this I'd say it's overkill, but to each his own). However, based on TypeRED's use of the phrase "standalone game", I'd say his intention is the former.
I'm not trying to be a downer here, I'm just baffled as to why this isn't just going to be released like any other FM.

OK, I see what you mean. So the issue is not whether there will be an independent executable file, but whether copyrighted assets will be distributed along with it. You can say exactly the same thing about the Open Dark Engine, though.

I don't see the connection with ODE, which is and will remain perfectly legal as it contains no code or assets from the original game, neither breaks any patent-enforced content protection.
Anyway, maybe TypeRED had to modify the gameplay executable, hence distributing it along with the content and making it illegal (breach of the Dromed Licence).
But who cares ? It's a niche mod for a niche game which is long dead by now for its publisher.
