If that was the case then you could copy all your music, books, etc. and give them away. Copyright has nothing to do with charging for something you distribute.

I can see that applying to actual sound files from TDP and TMA, but surely including names like Hammerites and Keepers, etc, in a downloadable mod is no different than writing fan fiction in the Thief setting and posting it on the net?
