Check the Steam Subscriber Agreement. It is in there, saw it myself. Something like "Valve may (but is not obligated to) release patches for games in the event they choose to discontinue Steam."

Ok I went and steamed Mount+Blade: fire and sword (better be good) X3:terran conflict (i want my space flight sims!) and Gothic 3 (sheer bloodymindeness). please tell me gothic 3 isnt as bad as people make out.

It's not. Now that it's been patched to hell and back, it isn't that bad a game. I wouldn't say it reaches the giddy heights of Gothic 1 & 2, or 3/4ths of Risen, but it's solid and fun.

Yeah, what's up with that? I quit just about immediately. Game's loading times didn't seem to improve any from when I had an Athlon 3200+ and a 6800 GT, and I've got 8 goddamn gigs of RAM now.

I played on that community patch you linked with the combat rebalanced tweak enabled and don't remember the first fight being unfair. I died a few times, sure, but I was getting used to the combat. A bad way of introducing you to the game, sure, but nothing impossible, surely.
edit: If it really is impossible for some reason, try to glitch through it, lure enemies to your invincible companions, lower the difficulty, do whatever it takes to get through it, and you won't have to deal with orcs until you get reasonably buffed.
And no, G3 is definitely not as bad as people say. I was one of those people until I actually gave it a proper chance. It's different from G1, G2 and Risen, which is not always a bad thing. I got many, many hours of joyful exploring, sidequesting and faffing about out of it.
Oh, and loading times? The first time it loads is pretty long, yes, but quickloads? A matter of seconds on my mediocre system, I was surprised.
