I don't know. If it is effectively the same as ditching used game functionality, then why go for the expensive/complex option?
If it's to protect their image by not directly clamping down on used game sales, then they must think the public are very stupid.

I think absolutely the latter.
The used games market costs them a considerable amount, after all: they clearly hate the idea of all those second-hand dealers profiting from their lovingly-crafted madden 20xx games or whatever.
But "works with secondhand games for a 35 dollar fee" sounds better for soundbites than "does not work with secondhand games".

True, but I think they're seriously underestimating the ability of the public to notice, figure out, sloganify and share details which affect purchases. If those prices are confirmed, any gain of reputation they are hoping to off-set against the cost of setting up these re-registration systems will be drowning in a mire of scumbag steve memes.
It just strikes me as a very poor move by MS, which is compounded with the generally tepid reception their X-Bone press reveal has given them. I wouldn't want to be their PR people right now.

It's worth reiterating that the used game market (which is monopolized by Gamestop) works like this in the US:
- Buy a new game for $60/play it
- Trade game into Gamestop for $10 credit towards another game
- Gamestop sells used game for $55

Whereas the new system would add $53 on top of that, thus making gamestop redundant - MS might as well paint devil horns on to a giant poster of Bill Gates.
Many gamers thrive on that eco-system. It's MS's product, so they're free to do what they like, but if Sony offer a more lenient system for allowing that system to exist, I won't be surprised if Sony takes a bigger market share for the next gen.
[EDIT] That GameStop shit is terrible (price-wise) though.
